Ervin Donnell (#53)'s Will

 

The following was transcribed by Susan Leach Snyder on June 14, 2016 from Record of Wills, 1771-1943 , Index, 1772- 1934; Author: North Carolina County Court (Guilford County), Probate Place: Guilford, North Carolina. Case Number 0896.

LAST WILL AND TESTAMENT OF ERVIN DONNELL

In the name of God Amen, I Ervin Donnell of the County of Guilford and State of N. Carolina being of sound mind and memory, Blessed be God do this ___ 20th day of February in the year of our Lord one thousand eight hundred & forty five make & publish this my last will and Testament in manner and form following to wit, that is to say first of all my just debt to be paid out of my estate. Secondly I give and bequeath unto my son Latham Donnell the sum of one dollar.

Thirdly I give and bequeath unto my following sons to wit John C. Donnell, Daniel J. Donnell, William M. Donnell & Robert H. Donnell all the Lands that I may are seized and pa___ off to be divided equally between them agreeable to valuation.

Fourthly, As to the remainder of my Estate both real and personal all except my riding Carriage, I give and bequeath unto my son John C. Donnell Nancy E Donnell , Daniel J. Donnell, William M. Donnell, & Robert H. Donnell to be equally divided between them. And should it so happen that any of my Children should die named in this fourth clause of this my Will before they arrive at the age of Twenty one years, it or their portion shall be equally divided between the survivor or survivors of my last Wifes children named in the fourth clause of this my last Will and Testament, And it is further my Will that all my family ___ together until next fall before a Division takes place and after allowing a comfortable support for the family the Ballance of the Corn and Bacon on hand to be sold and to be applied to clothing all my children named in the Paragraph and the balance if any after clothing my children I give unto my son John C. Donnell.

Fifthly I give and bequeath unto Polly Pritchett my riding carriage & _____.

I do hereby constitute and appoint and ordain my son John C. Donnell and my worthy friend Joseph Kirkpatrick Executors to this my last Will and Testament, hereby dis_____ all other Wills made by me In Testimony whereof I Ervin Donnell The Testator have hereunto set my hand and seal to this my last Will and Testament.
